Registered Design
A Registered Design covers the visual appearance of a product and can include the features of shape, configuration, pattern and ornamentation.
In order for a design to be registrable it must be new and distinctive; ‘new’ meaning a design cannot have been used publicly in Australia nor published in a document anywhere in the world; ‘distinctive’ meaning that the design is substantially different to other existing known or registered designs.
The owner of a Registered Design may be an individual, a company, an association or a partnership but where two or more people own interests in a design, they must apply jointly.
